Terms of service

Draft. Sikhaku has not launched and these terms have not yet been reviewed by qualified counsel. They describe how we intend to operate and will be replaced by a reviewed version before any real transaction takes place.

These terms are an agreement between you and Sikhaku, a Lacspace company (“Sikhaku”, “we”). By creating an account or buying a course you accept them. If you are publishing courses, the creator terms below also apply to you.

1. Accounts

You need an account to buy or publish a course. You must give accurate information, keep your login secure, and be at least 16 years old — or have permission from a parent or guardian. You are responsible for what happens under your account.

Your account belongs to Sikhaku, not to any individual creator. A creator only receives your identity once you buy one of their courses, and only in connection with that purchase.

2. Buying courses

  • Prices are shown inclusive of any tax due and charged in the currency the creator set.
  • Sikhaku is the merchant of record. We take the payment, issue the invoice, and pass the proceeds to the creator. Your contract for the purchase is with us.
  • Buying a course grants you a personal, non-transferable licence to access it for as long as we operate the service. It does not transfer ownership of the material.
  • Courses may be downloaded for offline study inside the Sikhaku app. Downloads are encrypted and tied to your account.
  • Refunds are governed by our refund policy.

3. Creator terms

  • You license your course content to Sikhaku so we can sell and deliver it. You keep ownership of everything you upload.
  • You set your own prices. Sikhaku charges no commission and no platform fee, so we pay you the proceeds of your sales in full, as set out on the pricing page. Any tax due depends on your own registration and is shown at checkout.
  • Payouts require verified KYC and are made on a regular schedule once your balance exceeds the minimum. Every payout is accompanied by a statement.
  • Refunds reverse the sale including our fee. If you have already been paid, the amount carries as a negative balance into your next payout run.
  • Your first course is reviewed before publication. We may decline content that is not educational, that infringes someone else’s rights, or that misrepresents what it teaches.
  • You may unpublish or leave at any time. Students who have already bought a course keep access to it.

4. Content and licensing

You must have the right to everything you upload — including music, footage, images and material created by anyone else. Uploading content you do not have rights to is grounds for removal and account termination.

Course video is protected with DRM and carries a watermark identifying the student watching it. Attempting to remove protection, record, redistribute or resell course material is a breach of these terms and may also be a breach of copyright law.

5. Acceptable use

You agree not to:

  • Share your account or resell access to courses you bought
  • Circumvent DRM, watermarking or payment
  • Upload anything unlawful, misleading, or not educational in nature
  • Scrape, reverse engineer, or attack the service
  • Impersonate another creator or misrepresent your credentials

6. Termination

You may close your account at any time. We may suspend or close an account that breaches these terms. If we close your account without cause, we will refund unused purchases and pay out any balance owed to you.

7. Liability

Sikhaku provides the platform. Course content is created by individual creators, and we do not guarantee any particular outcome from taking a course. To the extent permitted by law, our total liability to you is limited to the amount you paid us in the twelve months before the claim.
